The Ministry of Sports has revealed a draft of the licensing regulations for sports training institutes. The draft indicates that applications for obtaining or renewing a license will be submitted through the Ministry's website, in accordance with the guidelines issued by the Ministry in this regard. The applicant must adhere to the following requirements when submitting the application for a license:
Providing proof of the legal eligibility of the applicant’s representative, attaching the documents that fulfill the conditions and requirements stipulated in Article (Fourth) of these regulations, signing the relevant forms and declarations requested by the Ministry when submitting the license application, and submitting any other relevant documents or papers requested by the Ministry during the consideration of the application.
License duration
The license shall be valid for one year from the date of its issuance, and the licensee must submit a renewal application for the license before (30) days from the date of its expiry.
If the licensee does not submit a request to renew the license within the period specified in paragraph (1) of this article, the request submitted after that period shall be considered as a new license request, and the licensee must resubmit his request to obtain the license, fulfilling the requirements contained in Articles (Fourth) and (Fifth) of this regulation.
The licensee must, during the license's validity period, notify the Ministry and the Institute of any changes to the information related to obtaining the license, including information pertaining to the conditions and requirements stipulated in Articles (4) and (5) of these Regulations. The licensee may not commence the activity before obtaining the license, after its expiry, or upon its termination in accordance with the provisions of these Regulations.
Obligations
The licensee is obligated to:
Compliance with all applicable regulations and bylaws in the Kingdom, and any relevant instructions issued by competent authorities, as well as all technical standards and requirements issued by the Ministry and the Institute related to the activities and services it provides, and compliance with all circulars, decisions, and instructions issued by the Ministry and the Institute, and refraining from selling, promoting, using, or consuming any performance-enhancing substances not licensed by the Saudi Food and Drug Authority within its facilities, and refraining from advertising sports training and professional programs that do not meet the Institute's requirements and standards, and placing its name and logo on all documents issued by it, and not assigning its license to others or disposing of it in any way except after obtaining prior approval from the Ministry, and responding to any requests received from the Ministry within a period not exceeding three (3) working days, and notifying the Ministry of any change to the information and documents submitted to the Ministry for the purpose of obtaining or renewing the license, within a period not exceeding ten (10) working days from the date of the change, and notifying the Ministry of any change to the licensee's articles of incorporation, bylaws, or commercial registration – as applicable – within A period not exceeding (10) working days from the date of the change, and providing computer equipment and advanced software that contribute to developing and improving the services provided to subscribers, and providing periodic reports - as requested by the institute - that show the measurement of the satisfaction of subscribers and beneficiaries of the services provided, taking into account the regulations, rules and instructions related to data protection and cybersecurity, and approving sports training or professional programs through the institute’s website and in accordance with the regulations regulating this, and providing the institute with a list of the training programs it offers, including the names of the programs, their content, their duration and their requirements, and it is required to obtain approval for the training program before its implementation.
Violations and penalties
The draft revealed the violations and penalties in the regulations as follows:
Selling, promoting, or using any performance-enhancing substances not licensed by the Saudi Food and Drug Authority within one's establishment is punishable by a fine of 50,000 riyals. A second offense results in license revocation. If any information or documents submitted by the licensee to the Ministry under which the license was obtained are found to be false, the penalty is a fine of 30,000 riyals. A second offense results in temporary suspension of activity until the information is corrected, and a third offense results in license revocation. Failure to comply with official circulars or instructions issued by the Ministry is punishable by a fine of 30,000 riyals. A second offense results in temporary suspension of activity, and a third offense results in license revocation. Manipulating tuition fees or imposing illegal fees, conducting sports training or professional development courses or programs without obtaining the necessary approvals from the Leadership Development Institute, providing misleading or false information about sports training and professional development programs, failing to respect the privacy of trainees, discrimination, harassment, or any form of physical or verbal abuse is punishable by a fine of 30,000 riyals. A second offense results in temporary suspension of activity, and a third offense results in license revocation. Failure to provide appropriate safety equipment is punishable by a warning and closure of the establishment until the equipment is provided. A second offense results in... A fine of 20,000 riyals and closure of the facility until the equipment is provided, and a third time a fine of 30,000 riyals and cancellation of the license.
