Joint statement from the Professionalism and Disputes Committees regarding the Keno case
The Professionalism and Players' Status Committee of the Saudi Arabian Football Federation issued a joint statement with the Dispute Resolution Chamber regarding the signing
The Professionalism and Players' Status Committee of the Saudi Arabian Football Federation issued a joint statement with the Dispute Resolution Chamber regarding the signing of two professional contracts by player Mohammed Kanno with Al-Nasr and Al-Hilal clubs for the same period.
The committee stated the following in its statement:
1- Since January 9, 2022, the committee has initiated the necessary procedures in accordance with its general jurisdiction, without any party submitting a complaint, based on:
a) The first paragraph of Article (6) of the Professionalism Regulations, which stipulated: “Following up on the application of the provisions of these regulations and considering all disciplinary matters related to those addressed by these regulations and making decisions regarding them.”.
b) Paragraph one of Article (62) of the Professionalism Regulations, which stipulated: The committee has the right, within its authority or at the request of one of the clubs, to impose penalties on a professional player in the event that he commits one or more of the following violations:
1/4 Signing a professional contract with more than one club for the same period.
c) Paragraph one of Article (64) of the Professionalism Regulations, which stipulated: The committee has the right, within its authority, to impose penalties on the club in the event that it commits one or more of the following violations:
1/4 Negotiating with a player or authorizing negotiations or contracting in violation of the provisions of these regulations.
1/5 Inciting the player to breach his contract with his club.
2- As a result, the Professionalism Committee held 7 hearings for all parties, and several meetings, as the committee still has one final meeting with the player to clarify some of the documents that appeared during his international participation.
3- Before the last meeting of the committee, one of the parties filed a complaint before the Dispute Resolution Chamber against another party, and the defendant was addressed by the Chamber to submit his response in accordance with the specified time period, and in accordance with Articles 13, 15 and 16 of the Chamber’s regulations.
4- On February 11, the Professionalism and Players’ Status Committee received a letter from the Chamber stating that it had received a lawsuit from one of the parties involved in the case, and requested that it be provided with all files and documents related to the player, and the two professional contracts that were signed with the two clubs, as the dispute became contractual after the lawsuit was officially registered with the Chamber.
5- In order to safeguard the integrity of legal procedures with respect to subject-matter jurisdiction, given the possibility of any offending party being penalized twice for the same offense, the committee decided to refer a copy of the case file to the Chamber, including statements, hearings, and all related case documents, so that the Chamber may complete the necessary procedures in accordance with its jurisdiction to consider contractual disputes and impose sporting sanctions based on:
a) Paragraph 2 of Article 58 of the Basic Statute of the Saudi Arabian Football Federation.
b) Paragraph eleven of Article (24) of the Professionalism Regulations, which states: “When a professional player concludes more than one contract covering the same period, the Chamber shall apply the provisions stipulated in Chapter Sixteen of these Regulations.”.
c) Paragraph four of Article (43) of the Professionalism Regulations, which stipulated: “In addition to the obligation to pay compensation, sporting penalties shall be imposed on any player who is found to have violated the termination of the contract during the period protected by suspension, for a period of (4) months from playing in official matches, and in the case of severity, the suspension may be for a period of six (6) months….”.
d) Paragraph four of Article (43) of the Professionalism Regulations, which stipulated: “In addition to the obligation to pay compensation, sporting sanctions shall be imposed on any club if it commits a breach of contract termination, or incites such termination during the protected period. Every club that registers a professional player who has terminated his contract without a legitimate reason shall be considered an instigator of the breach unless proven otherwise. The sanctions shall be a ban on registering players, whether local or international, for two full and consecutive registration periods…”
e) Paragraph (I/d) of Article (17.1) of the Interpretive Regulations of the Regulations on the Status of Players issued by the International Federation (FIFA).
6- After the Chamber completes what is necessary in accordance with its special jurisdiction, the Professionalism Committee will proceed with its procedures in accordance with its general jurisdiction to consider all disciplinary matters related to those addressed by this regulation and to make decisions regarding them.
