The Ministry of Human Resources and Social Development announced a new update to the schedule of violations and penalties for the Labor Law and its implementing regulations. The updated version includes significant amendments to several violations, directly impacting the level of fines and mechanisms for addressing violations in the labor market. This includes ensuring workers' rights, professional conduct, safety requirements, and compliance. Among the updates is the inclusion of a violation related to an employer's failure to grant a working woman the legally mandated maternity leave. The Ministry classified this type of violation as "serious," resulting in a fine of 1,000 riyals for each affected worker. Another violation was added concerning establishments employing fifty or more female workers, or those with more than ten children under the age of six, failing to provide a dedicated childcare facility or nursery within the establishment. The fine for this type of violation reaches 3,000 riyals. Financial penalties were also imposed on employers who fail to apply appropriate disciplinary measures to employees who violate the dress code requirements. The Ministry estimated the fine at 300,000 riyals. The schedule also includes penalties for establishments that Failure to form a committee to investigate cases of misconduct, or failure to initiate an investigation within five working days of receiving a report, will result in a fine ranging from 1,000 to 3,000 riyals. This ensures swift action on misconduct violations and the provision of a safe work environment. Among the new amendments is a 500-riyal fine for establishments that do not comply with internal or external environmental requirements. Penalties related to engaging in activities that violate licenses have also been increased, particularly recruitment, outsourcing, or the provision of labor services without a license. These fines range from 200,000 to 250,000 riyals. The Ministry has also set a 200,000-riyal fine for entities that employ Saudis without a license, and fines ranging from 10,000 to 20,000 riyals if a worker leaves to work for another employer in violation of regulations. The new schedule details several violations, most notably the failure of a recruitment office to complete license renewal procedures before its expiry. This is considered a serious violation that leads to the suspension of the license for up to 12 months, in addition to a 5,000-riyal fine. The failure of the office owner to manage the office is also considered a violation. Establishing the business itself, or failing to meet the requirements for appointing a manager, constitutes a serious violation warranting permanent license revocation and a fine of 25,000 riyals. The schedule also includes classifying the failure to provide the Ministry with audited financial statements and accounting reports as a non-serious violation warranting a warning and a fine of 1,000 riyals. The amendments addressed stricter oversight of documenting required data and information through approved systems and platforms, classifying non-compliance as a serious violation warranting license suspension for up to one year and a fine of 5,000 riyals, which is multiplied according to the number of violations. Regarding "non-serious" violations, the updates stipulate the necessity of educating the recruited worker about their legal duties and rights. Failure to comply with this procedure is considered a non-serious violation punishable by a warning and a fine of 3,000 riyals, which is multiplied according to the number of violations. Concerning domestic workers, the Minister of Human Resources approved the schedule of violations for the Domestic Workers and Similar Categories Regulations, which includes explicit penalties for employers who violate legal obligations.
