The Ministry of Municipalities and Housing has introduced new requirements for serving tobacco in restaurants and cafes, and has sought opinions on the (Survey) platform in preparation for approving them. The requirements emphasized allocating a section for non-smokers independently from the section for smokers with no less than 30% of the total area allocated for serving. The Ministry did not prevent the separation of the activity of cafes and popular cafes if they have a food service, and it allowed popular cafes to serve tobacco products in open seating and separate rooms.
The requirements included: prohibiting the serving of tobacco products to the (restaurants with service) business in the outdoor seating areas on licensed sidewalks (sidewalk occupancy license), and prohibiting the display or sale of tobacco products as a product for external use by customers.
If tobacco products are served in the outdoor seating areas of restaurants and cafes, the seating must be completely concealed. Barriers must be made of vegetation or other materials that complement the city's architectural style, and must be at least 1.2 meters high. They must not have any sharp or jagged edges, nor contain any electrical components. The use of fabric, plastic, or untreated raw materials is prohibited. Both the exterior and interior doors of restaurants and cafes serving tobacco products must be self-closing.
The requirements included: providing the tobacco product serving area with natural or artificial ventilation, or both, to prevent the temperature from exceeding 25 degrees Celsius, vapor condensation, and dust and dirt accumulation; providing the storage area with natural or artificial ventilation, or both; applying the requirements of the Saudi Building Code in the design of ventilation and air conditioning; the ventilation and air conditioning system must be separated from the system designated for other places; and air circulation with other places (not designated for smokers) is not permitted.
The requirements include installing air purification devices, with a minimum of one device per 25m2 in the section located within the areas designated for smokers, and installing an air curtain on the doors that separate the smoking and non-smoking sections.
Tobacco product preparation rooms and stoves must be completely separate from food preparation and cooking areas. The flooring must be made of non-combustible materials, and a chimney equipped with an exhaust fan must be installed at least 2 meters above the building's ceiling, in accordance with the Ministry's chimney guidelines for commercial establishments.
Tobacco free of insects
The requirements stipulated that the tobacco products offered must conform to the standard specifications approved by the General Authority for Food and Drug, taking into account that the product is free from foreign materials (plant or non-plant) and from visible mold or strange odors, and that it is free from live and dead insects and their parts, and from rodents and their remains when examined by the naked eye.
The requirements prohibited the use of tobacco residues resulting from smoking or tobacco that has undergone any processes that lead to a change in its quality or characteristics when smoked, with the necessity of mentioning the name of the type and trade name, the country of origin, manufacture or packaging, and a health warning about the harms of using tobacco and its products.
The requirements recommended using a device dedicated to sterilizing and disinfecting the hookah and shisha, and that the hookah and shisha be cleaned and sterilized immediately after use to ensure its safe use from one person to another. The hookah and shisha and its accessories must be washed and dried after each use and stored in cabinets designated for this purpose, provided that they are rinsed immediately before use. The multi-stage washing method must be used (rinsing with running water, washing with detergents, then rinsing with water until the detergent is removed, and then drying).
Regarding the storage of tobacco products, the regulations stipulate the provision of at least one upright refrigerator for storing all types of tobacco, and the allocation of a separate area for storing tobacco tools, equipment, products, and charcoal, isolated from the rest of the premises. Shelves and cabinets must be made of durable, fire-resistant materials or stainless steel. The use of wooden pallets for storage is prohibited. Storing customers' hookahs (shisha) on the premises is also forbidden. The Ministry emphasized that these requirements aim to regulate the serving of tobacco, ensure compliance with product standards, and reduce the harm caused by secondhand smoke to non-smokers.
