The articles stipulated the monitoring of violations during the monitoring tours of activities or inspection visits to the facilities of those licensed or allocated, or periodic reviews of their performance, and that any report or complaint received with information and documents indicating the occurrence of the violation, in addition to any documents, reports, records or data received that show the existence of the violation, and any other means by which violations are monitored in accordance with the relevant regulations and bylaws.
The procedures for detecting, verifying, and proving violations include that the inspector, upon detecting any violation, shall issue a violation report containing a serial number, and the statements of the violator, or his legal representative, shall be heard in person and recorded in a statement report prepared for this purpose - which includes basic data, with recording the person's status. In the event of refusal to give statements regarding the violation, this shall be recorded in the violation report, and the procedures for detecting the violation shall be completed. In the event that the violator or his legal representative is not present during the detection of the violation, or in violations that do not require detection and proof to be carried out in the field or at its location, the statements of the violator or his legal representative shall be requested (in person or technically through technological means) and he shall be given a period not exceeding (15) days. The failure of the violator or his legal representative to respond to the request to give statements regarding the violation within the specified period shall be considered a refusal to give statements.
The statements of any party directly related to the violation are recorded, according to the inspector’s assessment (if present during the recording of the violation), in a report prepared for that purpose. The signature of the person to whom the statements are attributed, and their capacity, is taken on the report prepared for that purpose if the statements were heard in person. If they refuse to sign, this is recorded in the same report, and the procedures for recording the violation are completed.
The regulations stipulate that the inspector must verify the availability of the elements of the violation, the validity of its occurrence, and the sufficiency of the evidence to prove it and to prove that the violator committed it. The file of the claim of violation shall not be referred to the secretariat of the committee except after completing all the requirements for proving the violation, including the formal and substantive conditions stated in this article.

If the violator does not correct the violation during this corrective period, the claim file of the violation shall be submitted to the Secretariat of the Committee in accordance with paragraph (7) of this Article.
