1000 riyals fine for renting a car with less than a quarter tank of fuel

The Public Transport Authority stipulated that the operational lifespan of vehicles used in rental activities should not exceed 5 years from the date of manufacture, and the minimum operational lifespan may be increased for vehicles powered by clean energy.

This came as part of the amendments that the Authority proposed to the regulations to take opinions about them for approval in the future, and requested the provision of a suitable headquarters, in accordance with traffic requirements and approved municipal and technical requirements.

The authority added a new paragraph which reads: “The lessor may refuse to rent the vehicle to the lessee if there are outstanding and proven financial claims in his favor against the lessee with the competent authorities.”.

Among the amendments is that the amount of fuel in the standard tank of the car should not be less than a quarter as a minimum when the vehicle is delivered to the renter, and that a safety seat should be provided for children if requested by the renter, and that the date and time of reporting the theft of the car should be considered the end of the rental contract, if there is proof of reporting the theft from the competent authorities, and that the renter should not sign any additional papers other than the contract for the purpose of renting.

The regulations also included the addition of a new article: “The licensee may prevent the renter from smoking in the car and impose a financial penalty on the renter if he does not comply, taking into consideration informing the renter that smoking is not allowed in the rented car.”.

Among the amendments is that licensed establishments may provide booking services through electronic channels. The establishment is obligated to clarify the necessary means of communication for complaints, inquiries, and reports, with a clear pricing policy, a clear policy to regulate the cancellation or modification of a booking by the beneficiary or the lessor, obtaining the beneficiary's acknowledgment of having reviewed the pricing, cancellation, and modification policies before completing the booking process, and the necessity of providing the beneficiary with a booking reference number. In the event that the car booked by the beneficiary is not available, after the beneficiary's approval, the car will be replaced with a car of the same category. If a car of the same category is not available, it will be replaced with a car of the next higher category, without charging the lessee any additional costs. Otherwise, it will be replaced with a car of a lower category according to the tariff announced through the channels, after the beneficiary's approval, and the price difference will be refunded to the lessee.

Without prejudice to the Authority’s right to impose a financial penalty, the establishment is obligated to refund the amounts paid in advance through electronic channels, when the reservation is cancelled by the beneficiary or the lessor. The establishment has the right to cancel the reservation if the beneficiary’s data is incorrect.

The regulations imposed fines for violations, including the establishment renting a car with a driver if its approved rating according to service measurement points does not allow it to do so, with a value of 3,000 riyals, and the same for renting a car on an hourly basis if its approved rating according to service measurement points does not allow it, and 5,000 for renting a car that is not subject to the specifications and conditions of the regulations, and not providing the renter with a copy of the clearance when there are no financial obligations at the time of returning the car, upon the renter’s request, and 4,000 riyals for not issuing the contract through the specified electronic system.

A violation was also added: the licensed establishment renting a car with a fuel tank less than a quarter full, and its penalty is 1000 riyals.

Child seat violation

Failure to provide a child safety seat if requested by the tenant will result in a penalty of 1000 riyals, and failure to clarify the necessary means of communication for complaints, inquiries and reports through electronic channels will result in a penalty of 3000 riyals.

Among the violations added are: failure to adhere to the booking or booking details through electronic channels, with a fine of 3,000 riyals; failure of the establishment to refund prepaid amounts through electronic channels, with a fine of 2,000 riyals; and the tenant's signing of any additional documents other than the contract for the purpose of leasing, with a fine of 3,000 riyals.
