The Ministry of Resources has released a draft regulation for agricultural workers, private herders, and those in similar positions. It clarified that an employment contract is valid even if unwritten. In such cases, the worker alone may prove the contract and the rights arising from it by any means of proof. The contract must be for a fixed term. If it does not specify a term, it is considered to be for one year. If it includes a clause stipulating renewal for a similar or specified period, and both parties continue to fulfill its obligations, it is renewed for the agreed-upon term. If the contract does not specify a renewal period, it is considered renewed for one year.
The draft indicated that the two parties may agree to place the worker on a paid probationary period not exceeding 90 days from the date he begins work, during which the employer has the right to verify the worker’s competence. The worker may not be placed on a probationary period with the same employer for more than one period, and the two parties have the right to terminate the contract during the probationary period without any compensation.
According to the draft, a worker may not be employed for more than eight hours in a single day. The hours and rest periods during the day shall be organized so that the worker does not work more than five consecutive hours without a period of rest, worship, and food of not less than half an hour at a time during the total working hours. These periods shall not be included in the calculation of working hours. The employer must pay the worker additional wages for overtime hours equivalent to the hourly wage plus 50% of his basic wage. All working hours performed on holidays and vacations shall be considered overtime hours. A worker's wage may not be deducted except in specific cases, not exceeding one-quarter of the wage, including the costs of what he damaged intentionally or negligently, an advance he obtained from the employer, or the execution of a court ruling or administrative decision issued against him, unless the court ruling or administrative decision stipulates that the deduction may exceed one-quarter of the wage.
The worker has the right to leave work without notice while retaining all his legal rights if the employer does not fulfill his essential contractual or legal obligations towards the worker, if the employer’s treatment is characterized by cruelty, injustice or insult, if he assigns him, without his consent, work that is substantially different from the work agreed upon, if the employer has caused the worker, by his actions, especially by his unfair treatment or by violating the terms of the contract, to appear as if the worker is the one who terminated the contract, and if the employer or one of his family members commits an assault characterized by violence or immoral behavior towards the worker.
When does the worker bear the costs of returning?
The worker shall bear the costs of his return to his country if he wishes to return without a legitimate reason, and unless the contract includes specific compensation for its termination by one of the parties for an illegitimate reason, the affected party shall be entitled to compensation equal to two months’ wages if the worker does not fulfill his essential obligations arising from the employment contract, or stipulated under the provisions of this regulation.
If the worker intentionally commits any act or omission intended to cause material loss to the employer, provided that the employer informs the competent authorities of the incident within 24 hours of becoming aware of it.
If a worker is absent from work, the employer must adhere to the relevant regulations and procedures set by the Ministry. Dismissal is also permissible if the worker is found to have engaged in misconduct or committed an act that violates honor or integrity, or if it is proven that the worker resorted to forgery to obtain employment.
