The Jeddah Court of Appeals upheld the conviction of a man who burned his wife's face with acid, claiming she "disobeyed him and prevented him from seeing his children." The final verdict sentenced the husband to 10 years in prison and ordered him to pay the victim 100,000 riyals in compensation for her injuries, along with a strict undertaking not to harass her verbally or physically.
According to the details reviewed by Okaz, the husband poured acid on the wife’s face and fled. Saudi lawyer Najoud Qasim, from the National Committee for the Care of Prisoners, volunteered to defend the victim for five years of legal proceedings, along with a legal team and specialists from the Family Protection Association. The case ended with the wife being given a final ruling to avenge her burnt husband.
The "Wound Assessment" determines the percentage of disability
The court reviewed the medical report on the wife's injuries, which revealed burns to her face, left side of her head, back, and hands, along with scarring and disfigurement. The report assessed her disability at 25%. To determine the compensation for the injury, the court referred the case to a "severance appraiser" to assess the appropriate amount. The appraiser later determined that the compensation for the injury, based on the 25% disability, amounted to 100,000 riyals, equivalent to the blood money for intentional homicide. An initial sentence of five years imprisonment was issued against the husband. However, the Court of Appeal overturned the sentence, deeming it too lenient given the heinous nature of his actions. The court then sentenced him to ten years imprisonment for the public offense and ordered him to pay 100,000 riyals in compensation to the victim for the severe harm she suffered.
Dissolution of marriage and seeking protection
Okaz newspaper learned of the case of the burned wife, who was burned with gasoline by her husband on her face and parts of her body, causing disfigurement. The Family Protection Association took up the case, reporting that the victim had been married to a citizen for 25 years and had two children with him. In her initial complaint, the mother stated that her husband was mentally unstable and his behavior was unacceptable, forcing her to seek a divorce due to his mistreatment. She filed a case in the Personal Status Court and later filed a criminal complaint stating that her husband had attempted to kill her by pouring gasoline on her and setting her on fire, causing second-degree burns to her face, scalp, eyes, back, and hands. She was admitted to the burns unit for treatment and medical observation. Okaz also reviewed a medical report indicating that the husband suffers from chronic depression but is conscious and aware and does not exhibit any active symptoms of mental illness.

The head of the Tarahum Lawyers Committee, Counselor Ashraf Al-Siraj, told Okaz that a team of male and female lawyers was formed to follow up on the victim’s case before the Criminal Court and the Personal Status Court. He stated that a lawsuit was filed in the public and private rights by lawyer Najoud Qasim, who made great efforts along with a team of workers. He pointed out the continuous follow-up by the head of the National Committee, Counselor Ahmed Al-Hamdan, who emphasized providing judicial support and assistance to the affected woman, and housing was provided for her at the beginning, and her situation is being monitored.
60 months of follow-up on the case file
Lawyer Najoud Qassem said: The final ruling came after a series of procedures in the case and follow-up before the courts, the prosecution, the police, the emirate and the governorate until the fugitive husband was apprehended and brought to justice based on a judicial decision to bring him by force.
Qassem added that fellow lawyers, both men and women, participated in supporting the case, all volunteering to defend the wife who was unaware of her rights. She emphasized that the court had the final say and held the husband accountable in both public and private matters. She said she endured considerable hardship, as the case was complex, intricate, and fraught with difficulties.
The case was also initially complicated by the Coronavirus pandemic, and the medical reports issued against the wife were followed up with dozens of reports, memoranda and reviews to the competent authorities, and an initial ruling was issued and it was appealed until a final ruling was issued that became effective.
